UPDATE: Parents kidnapped Odessa boy from grandmother, leading to Amber Alert

ODESSA, Texas — NewsWest 9 has received an arrest affidavit from the Ector County Sheriff's Office on the two parents arrested for kidnapping a six-year-old boy in Odessa, leading to an Amber Alert issued Saturday.

On Friday, Sept. 20, ECSO responded to the grandmother of six-year-old Maxamillius Dominguez's residence because of a previous disturbance.

According to the affidavit, when deputies arrived to the grandmother's residence, she told them Maxamillius' biological father, Jose Dominguez, arrived to her home and started arguing with her. She tried to call law enforcement but Jose Dominguez slapped the phone out of her hand, took Maxamillius and left her home.

The grandmother decided she wanted to press charges and that is when the Amber Alert was issued.

A day later, Saturday, Sept. 21, deputies were able to find Jose Dominguez at a residence in Gardendale. While on scene, ECSO was not able to find Maxamillius.

The affidavit states that deputies were able to find Maxamillius later at another residence in Odessa with his biological mother, Vanessa Mariscal.

According to the arrest affidavit, a Child Protective Services representative verified through court documentation that the grandmother had full custody of her six-year-old grandson Maxamillius.

Since Jose Dominguez and Vanessa Mariscal are not custodial parents and don't have consent to take custody of Maximillius, both were arrested for third-degree kidnapping, according to the affidavit.

Both were booked into the Ector County Detention Center on a $50,000 bond.
