Midland man sentenced to 40 years for sexual assault

A Midland jury found 54-year-old Tony McCoy guilty on Wednesday afternoon after hearing two days of key evidence in the sexual assault case.

MIDLAND, Texas — A Midland County jury found a 54-year-old Midland man, Tony McCoy, guilty of sexual assault on Wednesday afternoon, according to a release from the district attorney's office. McCoy was sentenced to 40 years in prison, but must serve half of his sentence before the possibility of parole.

According to the release, Midland Police Department officers responded to a residence on July 2, 2022 due to an adult sexual assault call.

Through the investigation, officers learned that the victim was visiting as an acquaintance at the residence and was asleep in one of the bedrooms. McCoy was also a visitor in the home.

The release stated that McCoy entered the bedroom, crawled into bed with the victim and sexually assaulted her.

In court, jurors heard two days of evidence from MPD, witnesses at the scene, a DNA expert from the DPS Crime Lab in Lubbock and a SANE Nurse from Midland Memorial Hospital.

According to the release, McCoy's criminal history enhanced his punishment range to a minimum of 25 years up to life in prison.
