Motion to consolidate Heidelberg-David Wilson lawsuits denied

The two cases, both involving David Wilson, will now be tried separately.

MIDLAND, Texas — According to court documents and The Carlson Law Firm, a joint motion to consolidate two lawsuits involving David Wilson, the man found not guilty of murder in the shooting of MPD officer Nathan Heidelberg, has been denied.

The two cases are:

  • Nathan Heidelberg Jr. and Glendene Heidelberg (Nathan Heidelberg's estate) vs. David Wilson, BAM'S Security and Lydia Security Monitoring.

and

  • Wilson vs. Lydia Security Monitoring and BAM'S Security.

Filed on Nov. 6, the attorneys for the Heidelberg estate filed a joint motion to consolidate.

The filing was due to the plaintiffs believing that both lawsuits "arise from the same occurrence on March 19, 2019," the day Heidelberg was shot by Wilson.

The motion explains how both lawsuits involve the same parties, same subject matter and same witnesses, among other similarities. It claims that trying both cases together would remove "unnecessary duplication of testimony, evidence, expense and efforts by the parties and Court." 

It also claims that potential jurors would be confused and cause undue delay.

According to the Carlson Law Firm, that motion was denied last week, meaning both lawsuits will be tried separately.
