Hobbs Woman Sentenced for Death of Her Son

A Hobbs woman has been sentenced to 15 years in prison in the death of her 8-month-old son.

LOVINGTON, N.M. (AP) - A Hobbs woman has been sentenced to 15 years in prison in the death of her 8-month-old son.

Teresa Kincaid pleaded no contest to a charge of negligent child abuse resulting in death after Zachariah Ward died in July 2005.  She was sentenced Monday for the second time in the case. State District Judge Don Maddox earlier imposed a 24-year prison sentence but the state Court of Appeals struck down that term.

The appellate court found Maddox had wrongly determined that the crime was a serious violent offense that allowed him to add an additional six years to the sentence. The appeals court ordered him to sentence Kincaid again.
