Midland Woman Accused of Assaulting Public Servant

A Midland woman is behind bars for assault on a public servant.  Magdalena Gutierrez is being held on bonds totaling over $78,000.

MIDLAND, TX (KWES)

A Midland woman is behind bars for assault on a public servant.

Magdalena Gutierrez is being held on bonds totaling over $78,000.

According to Midland Police, Gutierrez was pulled over Monday night when an officer observed her swerving on the road.

When police pulled her over, they ran her information and found she had five outstanding warrants.

The officer allowed Gutierrez to call her mom to watch her kids because she would be taken in.

That's when things got violent.

According to the officer, Gutierrez would not get off the phone, resisted arrest and even tried to punch the officer.

The officer ultimately had to pepper spray Gutierrez in order to get her in handcuffs.

When police got him under control, the report says she tried to kick another officer and ems personnel who were trying to clean the pepper spray from her face.
